The Dangers of Setting Bad Judicial Precedent

 

 

"Stare decisis" is a legal doctrine by which judges will respect the precedent established by prior decisions.  This works well when judges are men who fear God and regard His Law—as summarized in the Ten Commandments.

 

God commands that judges be selected, "from all the people able men, such as fear God, men of truth, hating covetousness;" Exodus 18:21.  God says, "Take you wise men, and understanding, and known among your tribes, and I will make them rulers over you."  Deuteronomy 1:13

 

BIBLICAL REQUIREMENTS FOR A JUDGE

 

Therefore, the Biblical requirements for a judge (confirmed later by men like Alexander Hamilton in the Federalist Papers #78) are:

 

·       must be a man

 

·       must fear God

 

·       must be a man of truth

 

·       must hate covetousness

 

·       must have understanding

 

·       must be known among his community

 

The devastating consequences of unqualified judges who do not fear God, nor regard His Law, can be seen in the Supreme Court's decision in Griswold v. Connecticut in 1965.  In 1879, a law was passed in Connecticut prohibited "any drug, medicinal article or instrument for the purpose of preventing conception."

 

GRISWOLD v. CONNECTICUT

 

The law had been challenged several times, but had not been overturned.  But when Estelle Griswold, executive director of the Planned Parenthood League of Connecticut was arrested for violating the statute, she challenged the statute in what became known as Griswold v. Connecticut.

 

In 1965, Supreme Court Justice William O. Douglas wrote that a "right to privacy" which is not mentioned anywhere in the U.S. Constitution, was apparent in the "penumbras, formed by emanations" of the Constitution.

 

Douglas further held that this (smoke and mirrors approach) was enough to rule the 1879 Connecticut statute unconstitutional.  The Supreme Court's ruling in Griswold opened the door to a Pandora's Box of pretended rights to practice all sorts of immoral activity.

 

HOMOSEXUALITY AND ABORTION

 

Modern, ungodly judges have used Griswold as legal precedence to find the right to practice sodomy (homosexuality) in Lawrence v. Texas and a mother's supposed right to murder her child, in Roe v. Wade.

 

Modern courts now often appeal to international law as above the Constitution.  They change social norms as grounds for finding new rights and deleting old ones.  At the same time, they seek to remove every trace of Christianity from the public square.

 

REVOLUTION AND MASS MURDER

 

This is not altogether new.  For example, in the French Revolution:

 

·       The public worship of God was outlawed.

 

·       A new calendar was created to reject Christian chronology.

 

·       Christian holidays were abolished.

 

·       400,000 people were executed without trial or evidence.

 

Similar events occurred during the Bolshevik Revolution in Russia and Mao's Cultural Revolution in China.  It seems that America is heading down the same path today.

 

The Supreme Court in the United States has run out of control.  The only remedy is to replace the court with men of reputation and understanding, who fear God, hate covetousness and love His Law.

 

ROY MOORE AND THE TEN COMMANDMENTS

 

Chief Justice Roy Moore was such a man.  On November 13, 2003, the Alabama Court of the Judiciary removed Roy Moore from his position as Chief Justice of the Alabama State Supreme Court.

 

Why?  Roy refused to obey a federal judge's order to remove a monument to the Ten Commandments from the Alabama Judicial Building.  For this public acknowledgement of the Sovereignty of God, he was removed from office.

 

Yet Roy Moore (a West Point graduate and Vietnam Veteran) had a perfect right (and duty) to display God's Law in his courtroom.  Both the Bible (Deuteronomy 6:1-9)  and the First Amendment to the U.S. Constitution gave him that right.

 

"And these words, which I command thee this day, shall be in thine heart:  And thou shalt teach them diligently . . . And thou shalt write them upon the posts of thy house, and on thy gates."  Deuteronomy 6:5-9

 

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . ."
